And he sez he wants his job back ... he's going about it the wrong way. The attorney must need the publicity. When did it happen that an employer cannot fire an employee ... maybe it's a state thing. Seems to me that Waters even acknowledged some problems he was working on ... so some did exist. I say let him head to Akron and lead their band and not waste everyone's time and money just to listen to him whine ..... and in the statement below Waters didn't say ..... "suing The Ohio State University" .......
After disbursing a five-page “white paper” on legal topics surrounding the firing this morning, lawyer David Axelrod said that Ohio State denied Waters his constitutional right to due process. Waters said in earlier interviews that he had no plans to sue Ohio State, but Axelrod said it’s still a possibility.
“It’s an option, and if we can’t resolve it without filing a lawsuit, then we may do that,” Axelrod said.
In his report today, Axelrod wrote that Ohio State never gave Waters the chance to defend himself properly. Axelrod cited federal guidelines requiring schools to “include the opportunity for both parties to present witnesses and evidence,” but he said Waters never had that opportunity.
