Judge Andrew Napolitano describes two violations of the law that Obama engaged in during the release of the Taliban Five prisoners.
Judge Napolitano points out that the statute requiring the 30 day notice also prohibits the use of taxpayer dollars to facilitate a prisoner transfer in which the required notification does not take place. The first challenge then becomes that he unlawfully spent money.
Napolitano says, “The other unlawful behavior is far more problematic for the president, and that is the argument that by releasing these guys into the theater of war in the Middle East, he has provided material assistance to a terrorist organization.”
